We granted the defendant's application for further appellate review to decide whether the prosecutor's closing argument contained improper remarks and, if so, whether there was prejudice. In an unpublished memorandum of decision entered pursuant to its Rule 1:28, 35 Mass.App.Ct. 1104 (1993), the Appeals Court concluded that the prosecutor had made improper remarks, but that the defendant had incurred no prejudice.
