KLEINSCHMIDT, Judge.

The Defendant, Matthew Dean Hershberger, challenges the summary dismissal of his Petition for Post-Conviction Relief. He asks this Court to set aside his plea and sentence. For the reasons discussed below, we grant review and grant relief.
