POPOVICH, Judge:

This is an appeal from the order of September 21, 1993, entered in the Court of Common Pleas of Franklin County sustaining the preliminary objections of appellee ("Exxon") and dismissing appellant's complaint. We are presented with the question of whether the lower court erred in determining that, as a matter of law, Exxon owed no duty to appellant. Upon review, we affirm.
