Byard F. Brogan, Inc. and its workmen's compensation insurance carrier, Transamerica Insurance Group (collectively referred to as Employer), appeal an order of the Workmen's Compensation Appeal Board (Board) which affirmed an order of the referee1 denying Employer subrogation rights against proceeds of a third party settlement obtained by John Morrissey (Claimant). We affirm.
