This case began as a private condemnation action brought pursuant to section 11 of the Act of June 13, 1836, P.L. 551, as amended, 36 P.S. § 2731 (Act), pertaining to private roads. The case was referred to a Board of View (Board) and, following a view of the site and two hearings, the Board filed a Report and Award of Viewers, finding that the necessity existed to lay out and establish a private road from the landlocked property of David...
