Ordered that the order is modified, on the law, by deleting therefrom those provisions which granted summary judgment to the defendants on the plaintiff's first, second, third, and fourth causes of action, and substituting therefor a provision denying those branches of the defendants' motions which were for summary judgment dismissing those causes of action and reinstating those causes of action; as so modified, the order is affirmed, insofar as appealed from, without costs...
