John Weitzel, Inc., (Weitzel) appeals an order of the district court denying its motion to dismiss the court proceedings in a contract dispute between itself and William J. Baxter, a former employee.

Weitzel retained Baxter as its president pursuant to a written employment agreement dated February 19, 1990. On January 4, 1993, Baxter resigned, to be effective February 1, 1993. Shortly thereafter, a dispute arose between Baxter and Weitzel when...
