Convicted of possession of heroin with intent to distribute and sentenced as a second offender, the defendant appealed challenging the propriety of the judge's instructions to the jury immediately following the defendant's closing argument. The Appeals Court held that defense counsel had exceeded the limits of fair argument and that the judge had rightly criticized defense counsel's argument. Commonwealth v. Murchison,
