There is before the court, defendant, Benjamin Hosler's motion for judgment on the pleadings pursuant to Pa.R.C.P. 1034. Hosler filed his motion on May 2, 1994 along with a memorandum in support of his motion. Plaintiff, Theresa Dever-Gorka, responded to said motion on May 20, 1994 and also filed a brief contra Hosler's position.

Both parties agree that the pleadings are closed. Thus, this matter is ready for disposition...
