On 13 May 1991, the Hoke County Grand Jury indicted the defendant, Kerry Lemar Morston, for first-degree murder and conspiracy to commit first-degree murder. On 19 August 1991, the Grand Jury indicted the defendant for assault with a deadly weapon with intent to kill, inflicting serious injury and for discharging a firearm into occupied property.
