Defendant-appellant Martin Gerardo Perez-Torres (Perez) was convicted of reentering the United States after deportation, in violation of 8 U.S.C. § 1326. Perez was sentenced to a 5-year term of imprisonment. The district court enhanced Perez's sentence because prior to his deportation he had been convicted of an aggravated felony.
