Defendant appeals by leave granted from an order of the Macomb Circuit Court denying his motion for summary disposition pursuant to MCR 2.116(C)(5). We reverse.

Loretta Jean Mathieu and Joseph Mathieu were married on June 20, 1978, but separated in September 1978. In April 1979, Joseph filed a complaint for divorce. In the complaint, Joseph alleged that there were no children born of the marriage...
