These three cases arose out of Investguard, Ltd.'s foreclosure on a tract of property conveyed to it as collateral for a loan to Jack Jennings. Jennings purchased the property in question in 1988 with funds borrowed from Investguard, and Investguard retained a deed to secure debt on the property. At the time of the purchase, Chicago Title Insurance Company ("Chicago Title") issued a title insurance policy on the property, insuring against encumbrance...
