The state charged the defendant with robbery in the first degree in violation of General Statutes § 53a-134 (a) (3) and assault in the first degree in violation of General Statutes § 53a-59 (a) (1).1 The jury found the defendant not guilty of the first count, but guilty of the second count. The defendant appeals from the judgment of conviction of assault in the first degree. We reverse that judgment.
