Wolfgang Wagner and Photo-cut, Inc. were both charged in a two-count indictment with violations of § 6298(d)(2)(A) of the Resource Conservation and Recovery Act ["RCRA"] for unlawfully storing hazardous waste without a permit and unlawfully disposing of hazardous waste. 42 U.S.C. § 6298(d)(2)(A).
