Michael Damerville and Sharon Douglas entered guilty pleas to a one-count indictment charging them with conspiring with others to violate 21 U.S.C. § 841(a)(1), in violation of 21 U.S.C. § 846. Damerville was sentenced as a career offender. He argues that the career offender enhancement should not apply to those convicted of conspiracy to commit a controlled substance offense.
