On September 22, 1989, David Fiste, appellant, was driving in Ontario, Canada, when his vehicle was struck head-on by a drunk driver, Kenneth Collier, a Canadian citizen. Fiste sustained serious injuries in the accident and has incurred more than $250,000 in medical costs.
