Pursuant to a multi-count indictment, Day was convicted in 1990 of six counts of burglary, two counts of rape, and one count of aggravated assault. An order of nolle prosequi was entered on thirteen additional counts of the indictment, including six counts of burglary, three counts of rape, three counts of aggravated assault, and one count of possession of a knife during the commission of a crime.
