This case is before me on cross-motions for summary judgment. Plaintiff Franklin Potter (Potter), although he moves for partial summary judgment, is not requesting judgment as a matter of law. Instead, he seeks a determination that the exculpatory contracts which he executed do not preclude his claim against defendant National Handicapped Sports (NHS) as a matter of law.
