MATTER OF COMBS v. KELLY

210 A.D.2d 12 (1994)

619 N.Y.S.2d 559

In the Matter of Michael R. Combs, Petitioner, v. Raymond W. Kelly, as Police Commissioner of The City of New York, et al., Respondents

Appellate Division of the Supreme Court of the State of New York, First Department.

December 1, 1994

Petitioner's false statements along with, inter alia, the testimony of respondent's witnesses, constitute "substantial evidence" in support of the determination to dismiss petitioner from his employment with the Police Department. We note that the punishment of dismissal, under the circumstances, was warranted (see, Matter of Segrue v City of Schenectady, 76 N.Y.2d 758, 759).
