The Defendant was charged with Intimidating a Witness, a Class C felony, under Hawai`i Revised Statutes (HRS) § 710-1071(1)(a) (1985). Thereafter, the State and the Defendant entered into a plea bargain. The plea bargain provided, in pertinent part, that the Class C felony would be reduced to Terroristic Threatening in the Second Degree, a misdemeanor, and that the State, at sentencing, would be allowed to "argue for jail."
