Kenneth James Jackson was tried and convicted of capital murder in Jefferson County, Alabama. In a vote of 11 to 1, the jury recommended the death penalty, and, following a sentencing hearing, the trial court sentenced Jackson to death. The Court of Criminal Appeals affirmed the conviction and sentence. Jackson v. State, 674 So.2d 1318 (Ala.Crim.App.1993). We have granted Jackson's petition for certiorari...
