This is a criminal action stemming from the arrest of a protester who attempted to prevent the passage of a truckload of nuclear waste into the State of Idaho. The defendant was arrested for failure to obey the lawful order of a police officer after he refused to follow an Idaho State Police officer's instruction to move out of the way of the truck.
