Leroy Smith, Sr. (defendant), was charged by bill of information with third offense driving while intoxicated (DWI). LSA-R.S. 14:98. He pled not guilty and, after trial by jury, was convicted as charged. The court sentenced him to serve a term of 18 months imprisonment at hard labor, with "[a]t least the first six (6) months of the sentence" being served without benefit of probation, parole, or suspension of sentence.
