Kenneth Levy, the plaintiff, sued several defendants, including Victor Gust, Jr., and Robert Bakal. After a lengthy bench trial, the trial judge found that Gust and Bakal had breached their fiduciary duties to Levy and to the corporations in which all three men owned stock.
