Defendant, John E. Mingo, was initially charged by bill of information with possession with intent to distribute cocaine, a violation of LSA-R.S. 40:967A. After the trial court denied defendant's motion to suppress evidence, defendant pled guilty to an amended bill of information, charging him with possession of cocaine, a violation of LSA-R.S. 40:967C. Defendant reserved his right under State v. Crosby, 338 So.2d 584
