Defendant Osvaldo Martinez ("Martinez") was charged in a two-count Indictment with conspiracy to possess a quantity of cocaine with intent to distribute, in violation of 21 U.S.C. §§ 812, 841(a)(1) and 841(b)(1)(B), and failure to appear, in violation of 18 U.S.C. §§ 3146(a)(1) and 3146(b)(1)(A)(i).
