Harry Edward Thomas appeals the summary judgment entered in favor of appellee, Richard W. Von Hake. We previously dismissed Thomas's appeal because he was in contempt of an earlier trial court order. The Utah Supreme Court granted certiorari and remanded the case to us for limited briefing and reconsideration.
