A jury convicted defendant, Shirley Small, of stealing over $150 by deceit, in violation of § 570.030 RSMo 1986. The trial court sentenced her as a prior and persistent offender to twelve years imprisonment. Defendant's Rule 29.15 motion for post-conviction relief was denied after an evidentiary hearing.
