On September 11, 1992, the defendant, Darryl Phillips, was charged with unlawful possession of cannabis with the intent to deliver in violation of section 5(c) of the Cannabis Control Act (Ill.Rev.Stat.1991, ch. 56½, par. 705(c)). Defendant filed a motion to suppress evidence, and a hearing on the motion to suppress was held on February 11, 1993. On February 17, 1993, the trial court allowed the defendant's motion...
