LOBRANO, Judge.

The defendant, Calvin Duncan a/k/a Calvin Jones, was charged by grand jury indictment with first degree murder, a violation of LSA-R.S. 14:30. A jury found the defendant guilty as charged. He was sentenced to life imprisonment at hard labor without benefit of parole, probation or suspension of sentence. Defendant appealed and this court affirmed his conviction and sentence in State v. Duncan, 517 So.2d 1270
