Defendant, Stuart Andry, appeals the refusal of the trial court to "repeal" his conviction and grant him a new trial. Defendant was originally charged in this case with second degree murder under LSA-R.S. 14:30.1, but thereafter reached a plea agreement with the state to plead guilty to attempted second degree murder (LSA-R.S. 14:27 and 14:30.1) in return for a 40 year sentence.
