This is an appeal from a grant of summary judgment for the defendant, Boston Financial Data Services, Inc. (BFDS). All the materials that were before the motion judge are also before us on appeal.1 Cf. Pilch v. Ware, 8 Mass.App.Ct. 779, 780 (1979). Contrast Cambridge Hous. Authy. v. Civil Serv.
