OPINION

DRAUGHN, Justice.

This is an appeal from an order denying habeas corpus relief. In two points of error, appellant contends that he is being illegally detained because (1) the charge of attempted capital murder of a peace officer is barred by the jury's acquittal; and (2) the lesser included charge of aggravated assault of a peace officer is barred by the statute of limitations, by not being contained in the indictment, and because appellant was acquitted...
