OPINION

DRAUGHN, Justice.

Appellant was charged with the felony offense of possession of a controlled substance, namely heroin. The trial court denied appellant's motion to suppress evidence. Appellant then entered a plea of no contest pursuant to a plea agreement. The trial court found him guilty as charged in the indictment and assessed punishment at five (5) years in the Institutional Division of the Texas Department of Criminal Justice and a $1,000 fine...
