The plaintiff, the City of Peoria, filed a complaint alleging that the defendant, Joanne Ohl, violated section 5-4 of the Peoria City Code (the Code) which prohibited farm animals. (Peoria, Ill., City Code § 5-4 (1993).) The circuit court subsequently entered summary judgment in favor of Ohl, finding that her Vietnamese pot-bellied pig was "a pet and not a farm animal as defined by the City Code."
