The appellant, Jerry Hammond, was indicted on October 7, 1988, in Houston County, for the capital offense of murder committed during a robbery in the first degree or an attempt thereof, a violation of Ala.Code 1975, § 13A-5-40(a)(2). On September 14, 1990, a jury found him guilty of the capital offense charged in the indictment. A sentencing hearing was held before the jury, in accordance with §§ 13A-5-45 and -46, and the jury recommended...
