HICKS, Justice.

Appellant Jack Alan Prock was charged with murder in the death of Mr. John Miller, Sr. He was found guilty by a jury of the lesser included offense of voluntary manslaughter. The jury sentenced him to twelve years in the Institutional Division of the Texas Department of Criminal Justice.
