BACKGROUND

Michael David Murphy (Murphy) pled guilty to three counts of rape and two counts of robbery. In exchange for his guilty plea, the State dismissed three counts of kidnapping and one count of robbery. As a part of the plea agreement, Murphy agreed to waive his right to appeal from the judgment and sentence.
