The plaintiff appeals from a summary judgment. The issue is whether the plaintiff's testimony that the defendant's name and distinctive paint scheme were painted on the truck that caused the plaintiff's injuries is sufficient to establish a prima facie case that the truck was owned by the defendant and that the driver of the truck was using it within the scope of his employment as an agent of the defendant.
