On February 16, 1993, the Interstate State Commerce Commission ("ICC" or "Commission") granted CSX's request for exemption to abandon its 22.5 mile rail line between Bloomington and Bedford, Indiana. See 58 FR 8635-36. The exemption took effect on March 18, 1993. See id. The Monroe County Parks and Recreation Department ("MCPRD") subsequently sought to convert the abandoned rail line into a recreation trail...
