Plaintiff Ron Bailey was injured when a pneumatic nailer (nail gun) was accidentally discharged by a co-worker, K.C. Thompson, causing a nail to enter Bailey's head. Bailey originally sued Thompson's employer, Innovative Management. He later joined the manufacturer of the nail gun as a defendant.
