This appeal arises out of the conviction of the defendant, Charles "Chuckie" Matthews, for forcible rape in violation of LSA-R.S. 14:42.1. The trial court sentenced defendant to 40 years at hard labor, 10 years to be served without benefit of parole, probation, or suspension of sentence. Defendant appeals, contending the evidence is not sufficient to support his conviction and that his sentence is excessive.
