OPINION

LATTIMORE, Justice.

The City of Fort Worth appeals an adverse judgment rendered in this wrongful death case in favor of Lucille Adams, individually and as next friend for Leon Adams, a minor child, raising eight points of error. Fort Worth contends the trial court erred: (1) in overruling its pretrial plea in abatement and plea to the jurisdiction by declaring chapter 101 of the Texas Civil Practice and Remedies Code (the Texas Tort Claims Act)
