FACTS

In 1989, appellants/cross-respondents Carlos A. and Ondy Valladares "Valladares" owned a five-acre parcel of land in northwest Las Vegas. Desiring to subdivide the property into eight lots, Valladares enlisted respondent/cross appellant DMJ, Inc. D/B/A Southwest Engineering ("Southwest") to survey, parcel and water map the land.
