Defendant Henry Babauta Santos appeals from convictions of two (2) counts of aggravated murder, robbery, and unlawful possession and use of a deadly weapon in the commission of a felony. On June 10, 1991, this panel reversed defendant's convictions and remanded the case for a new trial on the ground that the trial court erred by giving the jury a non-statutory reasonable doubt instruction.
