ROBERTSON, Justice.

A jury found appellant guilty of five counts of theft, and the trial court assessed punishment at ten years confinement and a fine of $100,450 payable to the complainant. In six points of error appellant complains of the insufficiency of the evidence, an erroneous definition in the indictment, use of extraneous offenses without prior notice, and the trial court's failure to hold a hearing on appellant's motion for new trial.
