HARDBERGER, Justice.

Appellant, Bernardo Puente, Jr., was indicted for the offense of possession of cocaine and possession of cocaine with intent to deliver. Trial was before a jury on a plea of not guilty. The jury found appellant guilty and the court assessed punishment at ten (10) years' confinement in the Institutional Division of the Texas Department of Criminal Justice (probated).
