OPINION

BAKER, Justice.

Charged with driving while intoxicated, appellee moved the court to dismiss the information or to suppress the evidence. She alleged that the State destroyed favorable evidence. The court granted appellee's motion to suppress. The State contends the trial court erred in granting appellee's motion because appellee did not carry her burden under applicable Texas law.
