WEAVER, Justice.

Appellant, Danny Joe Daugherty, was convicted by a jury of the offense of burglary of a habitation. See Tex.Penal Code Ann. § 30.02 (Vernon 1989). The jury assessed appellant's punishment, enhanced by two prior felony convictions, at ninety years confinement in the Institutional Division of the Texas Department of Criminal Justice.
